Avoid Probate with a Small Estate Affidavit

When a loved one passes away, it's not always necessary to open probate to transfer the title of the assets to the heirs. One alternative to probate is the Small Estate Affidavit procedure, authorized by Arizona law. Arizona law allows family members to use an “affidavit of succession” where a person dies with less than $100,000 in real property value, such as a home, and less than $75,000 in personal property.

There are certain requirements and procedures that one must follow to effectively transfer title to the heirs by use of this affidavit of succession.

Over the years, Leary & Wence, PC has helped countless Arizona families determine if their estate qualifies for this unique legal process, and have safely guided them through it. Probate law can be very complex, so it's important to work with an experienced attorney who can ensure everything is handled properly. Don't risk the settling of your loved one's estate by taking on the process alone.

If you need help with a decedent's estate, whether opening probate or transferring assets, we welcome your inquiry regarding our legal services. To learn how we can assist you, contact Leary & Wence at (480) 388-3172.

Probate is a unique area of the law.
